Enforcer Services ( Trust Oversight & Governance Support)
Oversight and Monitoring
- Monitor trustee actions for compliance with the Trust Deed and applicable fiduciary standards.
- Review key trustee resolutions, minutes, and governance records for alignment with the Trust's terms.
Accountability and Reporting
- Request and review periodic reports, accounts, and relevant trust records (as permitted by the Trust Deed).
- Raise queries and require clarification from Trustees on trust decisions and administration.
Consents and Approvals (Where Applicable)
- Provide approvals/consents for specified trustee actions where the Trust Deed requires Enforcer consent.
Dispute Prevention and Governance Support
- Identify governance risks early and propose practical corrective steps.
- Support structured engagement to prevent disputes and maintain orderly administration.
Protecting the Beneficiaries' Interests
- Act independently, impartially, and in good faith, exercising Enforcer powers solely for proper purposes and in the best interests of the Trust and beneficiaries (as set out in the Trust Deed).
Confidentiality and Conflict Management
- Maintain strict confidentiality and avoid conflicts of interest.
- Do not derive any benefit beyond agreed remuneration for Enforcer services.
Escalation Measures (Where Permitted)
- Where concerns arise, take the steps permitted under the Trust Deed (including formal notices, calling meetings, or recommending professional advice) to protect the Trust's integrity.
